At this point, we all understand that lead is a hazardous material which poses serious health risks, especially for young children and pregnant women. However, lead has been used as a common construction material until relatively recently. While its use in construction was banned decades ago in the United States, lead-based paint is still present in many buildings that were built before 1978. Since lead paint is often hidden underneath layers of newer paint, visual inspections alone are not enough. Accurate detection of lead-based paint requires professional testing.

If a building was constructed before 1960, then there is a very strong possibility that lead-based paint was used on walls, woodwork, or other surfaces. Even if there isn’t any noticeable peeling or chipping, the risk of lead exposure still exists — especially during renovations or other events that may disturb the paint. A lead-based print inspection is essential, not just for the safety of the residents, but also to stay in compliance with New York City regulations (Local Law 31).

Under Local Law 31, all residential buildings constructed before 1960, regardless of whether or not lead paint is suspected, must be inspected for lead-based paint. This also applies to any residential buildings or rental units that were built between 1960 and 1978 in which lead-based paint is known to be present. This includes properties that may have been renovated, as lead-based paint may be concealed underneath newer paint. The deadline for completing these inspections is August 5, 2025. Property owners who fail to comply may face violations and penalties.
